PROCESSING OF ORDERS

DELIVERY

GPS Login Ltd. aims to dispatch all in-stock orders placed before 2:00 pm on the same working day using Royal Mail Tracked 24.

Whilst every effort is made to meet these dispatch times, delays may occasionally occur due to circumstances beyond our control. GPS Login Ltd. accepts no liability for any delays in dispatch or delivery caused by third-party carriers or unforeseen circumstances.

If an item is out of stock or otherwise unavailable, GPS Login Ltd. will contact you as soon as possible to offer an alternative product, an updated delivery timeframe, or a full refund.

CANCELLATION OF ORDERS PRIOR TO DISPATCH

Customers may cancel an order by contacting GPS Login Ltd. by telephone or email before the order has been dispatched.

Where a cancellation request is received prior to dispatch, a full refund will be issued to the original payment method used for the purchase.

CONSUMER CANCELLATION RIGHTS AND RETURNS

Customers are responsible for the cost of returning goods unless otherwise required by law. We recommend using a tracked and insured delivery service, as you remain responsible for the goods until they are received by us.

Refunds will be processed within 14 days of receiving the returned goods, provided they are returned in their original condition and in accordance with your statutory rights.

Customers may inspect goods as they would in a retail shop. However, any use beyond what is necessary to establish the nature, characteristics and functionality of the product may result in a deduction from any refund where permitted by law.

LIMITATION OF LIABILITY (GENERAL)

It is the responsibility of the customer to ensure that adequate network coverage is available in the intended area of use and that the product is suitable for their intended application. GPS Login Ltd. does not guarantee that tracking devices or services will operate successfully in every geographic location or under all operating conditions.

Customers intending to use tracking devices outside the United Kingdom are encouraged to verify operation and network coverage before deploying multiple devices. GPS Login Ltd. will provide reasonable assistance to customers seeking to test device compatibility and network availability.

Whilst GPS Login Ltd. will use reasonable endeavours to provide reliable tracking services, no guarantee is given that tracking information will be available at all times or that service interruptions will not occur due to factors beyond our control.

Nothing in these Terms and Conditions shall exclude or limit liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability which cannot be excluded or limited under applicable law.

ILLEGAL ACTS

Customers must provide accurate and truthful information when placing an order. The use of false identities, fraudulent payment methods, stolen payment cards, or any other misleading information when placing an order may constitute a criminal offence.

RETURNS AND WARRANTY

All products supplied by GPS Login Ltd. are covered by a 12-month warranty against manufacturing defects from the date of purchase.

If you believe a product is faulty, please contact us and return the item for inspection. If the product is found to be defective due to a manufacturing fault, GPS Login Ltd. will, at its discretion, repair, replace or refund the item in accordance with your statutory rights.

This warranty does not cover damage resulting from misuse, accidental damage, unauthorised modification, incorrect installation, normal wear and tear, or any other use outside the manufacturer's intended purpose.

Nothing in this warranty affects your statutory rights under applicable consumer protection legislation.

To the fullest extent permitted by law, GPS Login Ltd.'s total liability in connection with any order shall not exceed the purchase price paid for the relevant product or service.
GPS Login Ltd. shall not be liable for any indirect, incidental or consequential losses, including but not limited to loss of profits, business interruption, loss of goodwill, loss of data or damage to property arising from the use of any tracking device, software or service.
Tracking services rely on GPS, satellite, mobile network and telecommunications infrastructure operated by third parties. GPS Login Ltd. accepts no liability for interruptions, delays, loss of tracking data or service failures resulting from issues beyond its reasonable control.
Customers using their own SIM cards are responsible for ensuring sufficient credit, data allowance and network availability. GPS Login Ltd. accepts no liability for tracking failures caused by insufficient credit, network issues or telecommunications service interruptions.
Customers subscribing to GPS Login Ltd. tracking services are responsible for maintaining an active subscription. Tracking services may cease to operate where a subscription has expired, lapsed or been cancelled.
Product specifications, technical information and recommendations are provided in good faith. Whilst every effort is made to ensure accuracy, GPS Login Ltd. accepts no liability for errors, omissions or inaccuracies in published information.
GPS Login Ltd. may provide technical support services. Where support is provided outside standard customer support arrangements, additional charges may apply. Any such charges will be communicated to the customer in advance.
Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

SOFTWARE AND TRACKING PLATFORM

The following provisions apply specifically to the GPS Login Ltd. tracking platform, software and online services:

Customers are responsible for following all instructions relating to the installation, configuration and use of the software and tracking services. GPS Login Ltd. accepts no liability for losses resulting from a failure to follow such instructions.
To the fullest extent permitted by law, GPS Login Ltd.'s total liability in relation to the software, tracking platform or associated services shall not exceed the amount paid by the customer for the relevant subscription or service during the preceding 12 months.
GPS Login Ltd. shall not be liable for any indirect, incidental or consequential losses, including but not limited to loss of profits, business interruption, loss of goodwill, loss of data or damage to property arising from the use of the software, tracking platform or associated services.
Whilst GPS Login Ltd. uses reasonable endeavours to provide reliable access to its tracking platform, uninterrupted access cannot be guaranteed. Service availability may be affected by maintenance, software updates, telecommunications issues, network failures or circumstances beyond our reasonable control.
GPS Login Ltd. accepts no liability for loss of tracking data, delays in data transmission or failure of tracking services caused by mobile network providers, satellite systems, internet connectivity issues, telecommunications infrastructure or third-party service providers.
Customers using their own SIM cards are responsible for maintaining sufficient credit, data allowances and network availability. Customers using GPS Login Ltd. subscription services are responsible for maintaining an active subscription.
The GPS Login Ltd. tracking platform, software, website and associated intellectual property remain the property of GPS Login Ltd. Access to the platform is provided solely to authorised customers with a valid subscription or service agreement.
GPS Login Ltd. accepts no liability for software performance on devices, operating systems or hardware that do not meet the minimum system requirements specified by GPS Login Ltd.
Magnetic tracking devices are supplied with industrial-strength magnets. The customer is solely responsible for ensuring that the device is installed securely and appropriately. GPS Login Ltd. accepts no liability for loss of, or damage to, a tracking device resulting from incorrect installation or use.
Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability which cannot legally be excluded or limited.

TRACKING HISTORY

GPS Login Ltd. stores tracking history and associated data whilst a tracking device and subscription remain active.

GPS Login Ltd. reserves the right to remove inactive devices, accounts or historical tracking data from its systems where a device has not been used for an extended period of time or where the associated subscription has expired or been cancelled.

Customers are responsible for exporting and retaining any tracking history, reports or data that they wish to keep using the export facilities provided within the tracking platform.

Whilst GPS Login Ltd. takes reasonable steps to maintain tracking records and system backups, no guarantee is given regarding the long-term retention or availability of historical tracking data. GPS Login Ltd. accepts no liability for the loss, deletion or unavailability of tracking history, reports or associated data.

SERVICE AND NETWORK AVAILABILITY

GPS Login Ltd. may carry out routine maintenance, upgrades, repairs or other work on its tracking platform, website or associated services from time to time. Such maintenance may temporarily affect the availability of the service.

GPS Login Ltd. will use reasonable endeavours to minimise disruption and, where practicable, schedule planned maintenance outside normal operating hours.

Whilst GPS Login Ltd. aims to provide reliable access to its tracking platform and services, uninterrupted availability cannot be guaranteed. Service performance and availability may be affected by factors beyond our control, including mobile network coverage, satellite availability, internet connectivity, telecommunications infrastructure, third-party service providers and force majeure events.

Except for scheduled maintenance and circumstances beyond our reasonable control, GPS Login Ltd. will use reasonable endeavours to ensure that the service remains available to customers at all times.

ACCEPTABLE USE

The GPS Login Ltd. tracking platform and associated services must only be used for lawful purposes and in compliance with all applicable laws and regulations.

Customers must not use the service in any manner that is unlawful, fraudulent, abusive, harmful, or intended to infringe the rights or privacy of any individual or organisation.

The customer is solely responsible for ensuring that their use of tracking devices and tracking services complies with all applicable laws relating to privacy, data protection, employment monitoring and vehicle tracking.

The customer agrees to indemnify and hold harmless GPS Login Ltd. against any claims, liabilities, losses, costs or expenses arising directly from the customer's unlawful or improper use of the service.

Customers may permit authorised third parties, including employees, contractors or agents, to access the tracking platform. The customer remains responsible for all activity carried out using their account and for ensuring that authorised users comply with these Terms and Conditions.

GPS Login Ltd. reserves the right to suspend or terminate access to the service where it reasonably believes that the service is being used in breach of these Terms and Conditions or any applicable law.

CANCELLATION AND TERMINATION

GPS Login Ltd. reserves the right to suspend or terminate access to its products, software, tracking platform or services immediately and without prior notice where a customer breaches these Terms and Conditions, engages in unlawful activity, or uses the service in a manner that may cause harm to GPS Login Ltd., its systems or other users.

Customers may terminate their agreement with GPS Login Ltd. where permitted by these Terms and Conditions, applicable consumer protection legislation, or any separate subscription or service agreement in force at the time.

Termination of a subscription or service will not affect any rights, obligations or liabilities that have accrued prior to the date of termination.

Where a subscription has been paid in advance, any refund entitlement will be determined in accordance with the applicable cancellation policy and relevant consumer protection legislation.

DATA CHARGES AND SIM USAGE

M2M SIM cards supplied by GPS Login Ltd. are provided solely for use within compatible GPS tracking devices. Removal of the SIM card from the tracking device, or use of the SIM card for any purpose other than vehicle tracking, may constitute misuse and may result in the suspension or termination of the associated service.

GPS Login Ltd. reserves the right to monitor SIM usage to ensure compliance with these Terms and Conditions and to protect the integrity of its services.

Tracking devices may be used in countries covered by the applicable roaming agreements. Customers intending to use a device outside the United Kingdom should contact GPS Login Ltd. in advance to confirm coverage, roaming availability and any additional charges that may apply.

GPS Login Ltd. reserves the right to charge for excessive data usage, roaming charges or other costs incurred outside the scope of the customer's subscription plan.

ACCOUNT ACTIVITY

GPS Login Ltd. reserves the right to deactivate inactive tracking accounts, login credentials or associated tracking data where no device activity has been recorded for a continuous period of six months or more.

To maintain an active account, customers should ensure that their tracking device is powered on and connected to the tracking platform periodically during this period.

Customers who require continued access to historical tracking information are responsible for exporting and retaining any data they wish to keep.

LOST OR STOLEN SIM CARDS

Customers must notify GPS Login Ltd. immediately if an M2M SIM card is lost, stolen, or if they reasonably suspect that it has been used in an unlawful, unauthorised or fraudulent manner.

The customer will remain responsible for any charges incurred up to the point at which GPS Login Ltd. receives notification of the loss, theft or suspected misuse.

GPS Login Ltd. may request reasonable evidence of loss or theft, including a crime reference number or police report where appropriate.

Upon receiving notification, GPS Login Ltd. may suspend or terminate the affected SIM card and associated services to prevent unauthorised use and minimise any potential charges.

GPS Login Ltd. reserves the right to investigate suspected misuse, fraud or unlawful activity and may cooperate with law enforcement agencies or other relevant authorities where required.

DATA PROTECTION

GPS Login Ltd. is committed to protecting customer privacy and complying with applicable data protection legislation, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
